Defense Files Motion 11-19-09 to "Introduce Prior Bad Acts" By Roy Kronk

Anthony's Defense Says Meter Reader Has History Of Abuse, Restraining Women

Just after wrapping up the first day of his deposition, Casey Anthony's defense team has filed a motion alleging the man who found Caylee Anthony's remains could be responsible for the toddler's death.

Defense attorney Jose Baez filed the motion "to introduce prior bad acts and other circumstantial evidence pertaining to Roy Kronk" around 5 p.m. Thursday. The motion lays out the defense's strategy for the first time and claims a third party is responsible for Caylee's death.

The motion claims that Roy Kronk, the Orange County meter reader that discovered Caylee's remains in December 2008, has a history of abusing and restraining women with duct tape as well as holding them against their will. Caylee's remains were discovered in a wooded area near the Anthony family home.

The motion also alleges that Kronk could have a history of inappropriate behavior with young girls.

The defense said it interviewed two of Kronk's ex-wives and his son.

One ex said Kronk kidnapped her and held her for two weeks against her will using duct tape to restrain her.

The defense also claimed Kronk knew the location of Caylee's remains and may have had possession of them in November 2008.

The defense said the prosecution only has circumstantial evidence against Anthony in the first-degree murder case against her, and according to Florida law, for circumstantial evidence to prevail, all other options must be ruled out.

The motion asks the court "to allow Anthony to introduce at trial circumstantial evidence tending to indicate that a third party, and not Miss Anthony, is equally likely to be responsible for the death of the child Caylee Marie Anthony."

These allegations come the same day Kronk was deposed for several hours and the defense team unveiled its newest member, Mort Smith, a private investigator and professor at DePaul University.

Kronk's attorney, David Evans, issued a news release Thursday evening stating his client is a witness, not a suspect.

"Shortly after adjourning the deposition, the Anthony defense team filed a Motion, Memorandum of Law, and accompanying materials suggesting that Roy Kronk, the individual who found Caylee Anthony's remains and repeatedly reported his find to law enforcement agencies, should be considered a suspect in the murder of Caylee Anthony," Evans said. "He voluntarily appeared today and truthfully responded to all questions asked by Anthony's attorney. He has cooperated fully with law enforcement from Day One. He has nothing to hide, and has hidden nothing."

Evans said Kronk has always understood he may become a target of the defense.

"In their zeal to defend Casey Anthony, defense counsel has filed papers with the Court that are filled with allegations that have no basis in fact and falsely accuse Mr. Kronk of various types of bad behavior," Evans said. "The State will respond to these papers in due course in the criminal proceedings. As for Mr. Kronk, he vehemently denies the allegations against him and is confident that he will be vindicated. In the meantime, as he stated early on in this case, no good deed goes unpunished."

Kronk first reported finding something suspicious in the woods near the Anthonys' home on Aug. 11, 2008, but after three phone calls, a deputy came out and said he found nothing. That deputy, Richard Cain, was later fired from the Sheriff's Office for lying to his superiors about his encounter with Kronk.

Kronk is expected to be a key witness for the prosecution, but the defense apparently hired Smith to dig through Kronk's personal life.

Kronk's deposition will continue on Friday.

Anthony, 23, remains jailed on first-degree murder charges in the Caylee's death. Caylee's grandmother reported the toddler missing in July 2008, one month after she was last seen.

Amen, Estee!!!! They are really reaching on this one!!!!! I guess Kronk was driving KC's car with the stench of human decomp.. I guess Kronk went to the A home and got the blanket, the laundry bag, and the plastic bags.... oh, and the rare duct tape that matched the gas cans from the A home and the missing Caylee posters......

Geeze, give me a break.

ORLANDO, Fla. -- Casey Anthony's attorney filed a new motion to treat Roy Kronk, the former meter reader who found Caylee Anthony's remains, as a suspect in her death.

The motion, filed late Thursday, came after Kronk spent the day giving a deposition behind closed doors to the defense. It asks the court to allow the defense to introduce "prior bad acts" by Kronk.

Claiming evidence that Kronk "is involved in an imaginary world of fantasy and violence," the motion concludes by stating that "Roy M. Kronk should have been a suspect in this case."

Kronk, after his deposition on Thursday, said, "I haven't done anything wrong, and I maintained that all along."

His attorney, David Evans, said in a news release: "In their zeal to defend Casey Anthony, defense counsel has filed papers with the Court that are filled with allegations that have no basis in fact and falsely accuse Mr. Kronk of various types of bad behavior."

Kronk will come back for a second day of depositions in the case against Casey Anthony.

Defense points fingers at Roy Kronk as potential murder suspect

Casey Anthony's defense team is going after the former Orange County meter reader who discovered Caylee's remains, claiming there is circumstantial evidence that makes him "equally likely to be responsible for the death of the child."

Now, the attorneys are asking a judge to allow a jury to hear allegations of Roy Kronk's past wrong-doings, including inappropriate behavior with girls, use of duct tape to restrain women and holding women against their will.

Kronk's attorney, David Evans, said his client denies the allegations and understands this is Anthony's defense attorneys attempt to cast blame on someone other than their client.

"In their zeal to defend Casey Anthony, defense counsel has filed papers with the Court that are filled with allegations that have no basis in fact and falsely accuse Mr. Kronk of various types of bad behavior," Evans said in an e-mail. "The State will respond to these papers in due course in the criminal proceedings."

So far, the information in the defense's motion, which included hundred of pages of interviews, could not be verified by the Orlando Sentinel.

Transcripts of interviews with Kronk's two ex-wives, son, and a longtime live-in girlfriend's daughter depict the former meter reader as an untrustworthy man willing to resort to violence. No police reports or other supporting documentation were provided.

Ex-wives Jill Kerley and Crystal Sparks said Kronk physically attacked them. Sparks said she called police, but could not remember if she filed a restraining order. Kerley said he used duct tape to hold her against her will.

Both ex-wives said Kronk tells tall tales.

"I don't think he would know the truth if it hit him upside the head," Kerley said, who was briefly married to Kronk in the early 1990s.

Kronk's son Brandon Sparks said the former meter reader told him before Thanksgiving 2008 that he found Caylee Anthony's body and would be on television. Brandon Sparks shared the news with his wife.

"We both didn't pay any mind, though. We both thought it was far-fetched," Sparks said.

Casey Anthony, 23, is charged with first-degree murder in the death of Caylee. The toddler was reported missing in July 2008. If convicted, Anthony could face the death penalty.

The legal request was filed late Thursday, moments after Kronk finished a day-long questioning by defense attorneys at the State Attorney's Office. Another day will be scheduled soon.

"I know I haven't done anything wrong and so I have no reason to be fearful," Kronk said afterwards.

Kronk called detectives after he found the toddler's remains less than a mile from her family home in east Orange County on Dec. 11. He told authorities that he had tried to alert them four months earlier but his tips were shrugged off by deputies.

Defense Says Kronk May Have Killed Caylee

ORLANDO -- For the first time, Casey Anthony’s lawyers are pointing the finger at someone else.

They're identifying Roy Kronk as a person who may have killed Caylee.

In a motion filed late Thursday afternoon, the defense said:

* they have evidence Kronk has a possible history of inappropriate behavior with young girls
* that he has used duct tape to restrain women
* that he has a history of abusing and restraining women

The defense wants to grant what's called third party status to Kronk.

Essentially, they’re saying the evidence against Anthony is circumstantial, and there's just as much circumstantial evidence against Kronk, so they want to introduce his background in court.

Shortly after the motion being filed by Anthony's defense team, Kronk's attorney, David Evans, released the following statement.

"Today, the Casey Anthony defense team commenced, but did not complete, the deposition of Roy Kronk in the State v. Casey Anthony case. Shortly after adjourning the deposition, the Anthony defense team filed a Motion, Memorandum of Law, and accompanying materials suggesting that Roy Kronk, the individual who found Caylee Anthony's remains and repeatedly reported his find to law enforcement agencies, should be considered a suspect in the murder of Caylee Anthony.

Mr. Kronk is a witness, not a suspect. He voluntarily appeared today and truthfully responded to all questions asked by Anthony's attorney. He has cooperated fully with law enforcement from Day One. He has nothing to hide, and has hidden nothing.

It is the nature of criminal defense to attempt to find someone to blame for a crime other than the person charged. We’re still going over the documents and will have much more throughout the evening.

OK, if this wasn't so sad and involved beautiful little Caylee being murdered, it would almost be comical. So, Baez, which is it, Kronk did it, a stranger did it, Amy, Ricardo, Jessie or Tony are code for Zani the nanny, or once KC explains what happened we will ALL understand what happened? I know that the only things the jury can consider is what is heard IN court. However, there is NO way, any human being who will be on that jury will be able to forget all we have heard from the defense ITSELF, as to what the possible scenario is. The defense and from KC, as they speak FOR HER, has said so many different things, no one will EVER believe Kronk, who never even knew who KC was could have done this crime. I actually think that not only will they dismiss this fairly quickly, it will anger a jury that she is trying to blame toe ONE person who brought Caylee out of that swamp! I know it would anger me!
I am trying to imagine the cartoon moment during or directly after the deposition with Roy Kronk, when the defense got this NEW bright idea to blame Kronk. That must have been priceless to see. Then him running to file this silly, ridiculous motion. Oh, yet AGAIN!

Since the defense team has been perusing the blogs they have seen Kronk being held suspect by commentors moreso than Jesse, his father, Amy, Ricardo and Tony (they have seen the ire of commentors concerning implicating these friends of Casey's). I think they are hoping that there will be one or two jurists who will think the same.

I can't see Judge Strickland granting this motion.

Tracey, I think they knew before the depo yesterday that they were going to file this motion... They had it ready. They were just waiting until the last possible moment on the day of the depo to file it.

ORLANDO -- Allegations that former meter reader Roy Kronk may have been involved in Caylee Anthony’s death are not only coming from Casey’s defense team, they’re also coming from Kronk’s own family.

The defense filed an enormous motion with the court late Thursday.

It includes video of interviews with Kronk's family members.

In the motion, lawyers stop just short of saying they believe Kronk killed Caylee, and they've uncovered some extremely incriminating aspects of Kronk's past.

Mort Smith, Defense Investigator: When you learned Roy had found Caylee's remains, what went through your mind?
Jill Kerley, Kronk’s Ex-Wife: That he had done it.
Smith: Meaning?
Kerley: He probably was the one who murdered Caylee Anthony or had something to do with it.

Kronk and Kerley divorced after four months.

“It was abusive -- mentally and physically,” Kerley said. “He beat me up in front of his dad and I had to go the hospital. He duct taped my hands one time.”

Defense attorneys are clearly trying to connect Kronk to duct tape found at the crime scene with Caylee's remains.

Kerley: He said it was 100 mph duct tape.
Smith: And how often did he duct tape you?
Kerley: On two occasions.

Crystal Sparks, another ex-wife of Kronk’s, was also interviewed.

“I think there's a lot of concern for Roy being around young girls,” Sparks said. “Roy is not heard from. Roy is not seen. Roy is just non-existent in our lives, which is great for us.”

During her interview, Sparks also spoke about alleged abuse with Kronk.

“He made threats. He made constant threats against me,” Sparks said. “It was not uncommon for him to say 'I should have killed you when I had the chance.' I heard that all the time.”

Kronk called 911 three times in August 2008, saying he saw something suspicious in the woods off Suburban Drive.

Two weeks before Thanksgiving and a month before he reported finding Caylee's remains, he called his son Brandon and told him he was going to be a hero and appear on TV.

“‘I know where Caylee is and I'm going to go get her,’” Sparks said, quoting her son Brandon.

Those two interviews are just two pieces of the puzzle Casey's lawyers are using to create reasonable doubt.

They indicate in their motions that Roy Kronk “knew of the location of Caylee Anthony's remains and indeed may have had possession or control of them in November 2008” and they wrote that “Roy Kronk, and not Miss Anthony, is equally likely to be responsible for the death of Caylee Anthony."

“The more I think about it, the more my gut tells me he had something to do with it,” Kerley said.

After hearing about the motion, Kronk's attorney David Evans issued a statement:
