Check Fraud Case - Possible Plea Deal

As a break from my recent juvenile rants about other lawyers’ cluelessness, I am going to address a more serious legal issue; the significance of Casey Anthony’s check fraud case in relation to her First Degree Murder case.

This will be the first of a two part series and this first post will discuss why the State would want to try the Check Fraud case before the First Degree Murder case. The second post will discuss how the defense will likely try to avoid trying the Check Fraud case first.

As a refresher, in her Check Fraud case, Casey Anthony is charged with thirteen separate felonies that also happen to be crimes of dishonesty. Now in relation to the Murder case, the Check Fraud case would seem insignificant.

However, it is the 13 separate convictions that the Check Fraud case provides which is the true strategic prize for use in the Murder case. But why?

cant really claim one armed man in this one sweetie.. sorry!!

Casey Anthony Defense Wants Fraud Trial Moved
Defense Also Wants Jail Visits To Not Be Taped

ORLANDO, Fla. -- Casey Anthony's attorney said he will move forward with asking that her check fraud trial be moved and said he wants the jail not to videotape future visits.

The check fraud trial is scheduled for January. Anthony is currently in the Orange County jail awaiting a murder trial in connection with the death of her daughter, Caylee.

Prosecutors said surveillance tapes show Anthony passing bad check after check, bleeding her friend's account dry. Due to pre-trial publicity Jose Baez said he still wants the check fraud trial moved. Defense attorney Richard Hornsby said it's likely Judge Stan Strickland is waiting as long as he can in case of a possible plea deal.

But Hornsby said he doesn't expect a plea. Prosecutors want multiple fraud convictions so they can use that against Casey in her murder trial.

"They want to be able to impeach Casey Anthony on any statements attributed to her in her murder case," he said.

Baez also said he hopes the defense can persuade Strickland to limit or eliminate videos of Anthony's jail visits.

"What happened with the other visits was horrible," Baez said.

He said the state's release of those videos "is used to paint an ugly picture of her."

Hornsby said that argument won't work.

"Every court is going to say, 'No, we're not going to give special treatment just because she happens to be in a high profile case.' No chance he's going to win on this particular motion at all," he said.

Hornsby said it's not too late for Baez and his team to have the check fraud charges delayed and tried with the murder case. That would eliminate any advantage prosecutors would have in trying this fraud case earlier.

Hello again my unfaithful readers!

In part one of this two-part expose on Casey Anthony’s Check Fraud case, we discussed why the State wants to try the Check Fraud case before the First Degree Murder case.

In part deux, we will discuss why the Defense will likely try to postpone the Check Fraud case in some manner.

But before we discuss the how and why the defense will try to delay the Check Fraud case, I think it is best that we discuss what I would be doing.

Because there is nothing more enjoyable than second guessing another person’s strategy by playing Monday Morning Quarterback.

I'm sure all the normal places (WFTV, WESH, Orlando Sentinel, etc.) we have seen the hearings will stream the trial live.... as soon as we get links, we will post them. I have not yet heard if truTV will carry the trial live, but my guess will be yes.

We will also have an interactive thread for discussion during the trial.

Also, after the trial, we will post it as soon as possible for those who are unable to watch it live.

Fear not!!! We will try to take care of everyone!!!

There's no way I'd miss it...Won't even logon for work that day unless the trial is after noon....I wonder if the murder pretrial on the 21st will be telecast??? If so I'll be glued there too...

Estee, I'm sure the networks that previous carried the hearings will also stream the hearing live. We will posts links to those, as well, as soon as we get them and then post it afterwards.

Again, I will open an interactive thread for discussion during the pre-trial hearing.....

The live streams are definitely the best because they don't have anybody commentating. I'm pretty sure that CNN, TruTV or any other TV station that broadcasts it will have commentating. The worse part is that some stations split the screen and show the commentators while they are talking. It wouldn't be so bad if they only talked when nothing was going on.

I hope to be able to join some of the discussions in the interactive thread during the trial. On days when it goes past 2 p.m., I'll be able to.

The pre-trial hearing is currently scheduled for January 21 at 10:00 a.m. EST.

The fraud trial is currently scheduled for January 25 at 10:00 a.m. EST.

honestly, i am not even sure WHY they are having a trial... i know there is that little detail ... you know the one, (the constitution)... BUT..

THEY HAVE VIDEO OF HER COMMITTING THE CRIMES.. seriously, what more do you really need??

i wonder how long stan the man will allow the defense to ramble on with inconsequential motions and arguments BEFORE he points to the video and says... umm... let me think--- GUILTY!!

ORLANDO -- Casey Anthony’s check fraud trial was supposed to start Jan. 25.

However, News 13 has learned the trial isn’t going to happen.

Anthony is facing charges of stealing checks from her friend Amy Huizenga.

Meanwhile in Anthony’s murder case, there are still motions connected to the case that haven't been heard, such as a change of venue.

Sources told News 13 certain depositions still haven't been taken.

According to sources, a court hearing connected to Anthony's murder case scheduled for this week also will not take place.

Casey Anthony’s check fraud trial was supposed to start Jan. 25. However, News 13 has learned it's not going to happen.

I'm not gonna hold my breath waiting for this to happen....Wonder whose depos need to be taken and when we will hear about the motions still being pondered...Perhaps we will get some kind of update soon...If the depos need to be taken by the defense I wonder if this could be another STALL tactic...Needless to say, time will tell...

Well, it appears the defense has succeeded in postponing the check fraud trial after all......

Apparently there are some depositions that have not yet been taken. Anyone care to guess WHICH SIDE is derelict in getting depositions taken in order to be ready for the trial????

This is just getting WAAAAYYYYY beyond ridiculous!!! If KC was anyone else, they would have already had the fraud trial, gone into the murder trial as a convicted felon AND already been convicted of 1st degree murder and be IN PRISON!!!!!!

Why this special treatment??????

And just WHY weren't the depos taken???? AL could be the cause...after all she had her book to promote and Bubba Baez couldn't get feed back from her...No doubt this will stall the murder trial too...Do you still think it will happen sometime THIS year???

There has to be a point in time when Good Judge Stan says, No way Jose...No more stalling...Depos or not we are going ahead with this...The defense has had enough time to do their groundwork...The State had more depos to take than the defense and they are done; as far as I know...
