In attempting to get hearsay statements admitted in Drew Peterson’s murder case, Will County prosecutors today found themselves arguing against the very law they helped create.

Saddled with a botched police investigation several years ago, State’s Attorney James Glasgow had pushed for a state statute that would allow hearsay statements against Peterson at trial. Dubbed Drew's Law by legal experts and legislators, he hailed the bill's passage as a way of letting Peterson's third and fourth wives speak from the grave.

It will be two or three months before we know the justices decision...It will seem like a lifetime...Enough time has passed, this trial needs to get under way...At one point I was thinking it would happen before Casey's trial, but given the recent circumstances I don't think it will...I wonder if it is not favorable for either side, will it go to a higher court, and will they let Drew out until he actually has to stand/sit before a jury...

Drew Peterson's attorneys ask for his release

(CBS/WBBM) JOLIET, Ill. - Former Bolingbrook police Sgt. Drew Peterson, who is being held for the death of his wife Kathleen Savio, took his case to the Illinois Supreme Court on Tuesday. He's trying to get himself released from jail.

Peterson has been in custody at the Will County Jail on a $20 million bond for more than two years as he awaits trial on murder charges in the death of his wife, reports CBS station WBBM.

He had been set to go on trial in July 2010, but the trial was postponed the day before the jury selection was to begin due to an appeal by prosecutors seeking to allow hearsay statements. The Illinois Appellate ruled in July that prosecutors had filed their appeal late.

Prosecutors are now appealing that decision to the Illinois Supreme Court which could take more than a year.

Drew Peterson to stay in jail during appeal, state Supreme Court rules

Murder suspect Drew Peterson will remain behind bars while the Illinois Supreme Court weighs a critical appeal from Will County prosecutors.

The court late Monday refused to order his release from the Will County Jail, where he has been detained on $20 million bond since his May 2009 arrest on charges he drowned his third wife, Kathleen Savio.

But the ruling left Peterson’s attorneys “hopeful” the high court will not hear the appeal from prosecutors, which could clear the way for Peterson to stand trial in the next few months.

I just read on Justice Cafe that there is an article at www.chicagotribune.com about one of Drew's at
torneys being under scrutiny and released from his duties on the civil cases...Check it out...It's under the NEWS heading for CHICAGOLAND..or it can be found by a search for drew peterson at the chicago trib site...

I watched it and for some reason, I already knew everything it showed. I feel like we have lived this entire story by being connected to RC. When is his trial supposed to be? Anyone know?

Mama, it's hard to say when his trial will start. It was originally scheduled to begin in August of 2009 and then delayed until June 13, 2010. It was delayed again until July 8, 2010 with the Judge saying this would be the final delay to the proceedings.

Then on July 7, 2010, the start of the trial was delayed again when prosecutors filed an appeal because the Judge barred key hearsay evidence from the trial. Of course, the only reason it is hearsay is because Drew's victims aren't alive to testify about statements they made to family and friends.

They are still waiting while the Illinois Supreme Court decides whether they will hear the appeal regarding the hearsay evidence. I don't think prosecutors feel very confident in obtaining a conviction without the hearsay evidence being admitted.

I guess everyone knows by now that the hearsay statements WILL be allowed...So says the recent appellate court ruling...Now that this has happened Drew can proceed to trial...Should be some time late Spring (June) or early Summer...Can't wait to see his sleezy self in the courtroom...I hope he opts to be put on the stand...

Drew Peterson's lawyers return to court Thursday to argue whether testimony from the divorce attorney for Peterson's deceased ex-wife violated attorney-client privilege.

Prosecutors have won the right to use hearsay evidence at trial, but defense motions will be argued about testimony given by attorney Harry Smith.

The defense claims Smith violated his attorney-client privilege when he testified about conversations he had with Peterson's ex-wives Kathleen Savio and Stacy Peterson.
