Ineffective Assistance of Counsel???

Post by Snaz on Sat Jan 30, 2010 5:42 pm

This just makes me ANGRY!!! KC has assembled herself a virtual dream team that most normal people couldn't even begin to afford (all at no cost to her, I might add.... and even though they constantly threaten to proceed with filing for indigent status). For KC to ever claim ineffective assistance of counsel would just be beyond belief. OK, it's a given that JB is an idiot and has made some really STUPID mistakes.... but KC has Andrea Lyon now who is her lead counsel (when JB lets her be), since JB is not qualified for a death penalty case (geeze, is he even qualified to be an attorney??).

This video (February 2, 2009) was before the death penalty was put back on the table (April, 2009, I believe), so maybe if Richard Hornsby were to be asked the same question now, he would have a different answer.

What are your thoughts on whether or not KC could claim ineffective assistance of counsel should she be convicted?

Snaz, I sometimes think the Anthony's are banking on being able to appeal because of ineffective assistance of counsel, and that's why they haven't fired Bozo yet. Unfortunately, they may have a case. That article you posted a few day from Bill Sheaffer's blog highlights plenty of mistakes that have been made by the defense even with Andrea Lyon on the team.

Could the "ineffective" counsel claim that Casey refused to heed their combined advice...therefore "they" are not at fault?

honestly, i do not believe that she can claim ineffective counsel based on the fact that her attorney is NOT court appointed.. he is on HER payroll (per say) and she is at free will to dispose of him anytime she wishes. she picked him..

to prove bozo ineffective at this point would be almost impossible. yes, he has done some things that we see as stupid, but he has done the best job anyone ever could when faced with a thoroughly guilty client. he has filed motion after motion on her behalf, he has shown up at every court date (even when miss anthony herself declined to attend).. he has never been shown impared, and he does everything "publically" to show that he is personally attached to this case.

not only that, but there are several attorneys working on her case, including the famous (or infamous.. not sure) miss lyons, and to get a conviction overturned for ineffective counsel, she would have to prove them BOTH ineffective.. considering miss lyons is considered both lead counsel and 1st chair... good luck with that..

so... IMHO there will never be any grounds to appeal or try to overturn on this...
