SAN DIEGO — A man once imprisoned for molesting a child is going back — this time to serve a life term for raping and murdering two girls in a case has sparked calls to change the way child sex predators are punished.
John Albert Gardner III, 31, will be sentenced in San Diego Friday under a plea agreement that spared him the death penalty but denies him any possibility of parole.
Gardner's guilty plea last month to killing 14-year-old Amber Dubois and 17-year-old Chelsea King has sparked a far-reaching review of how California deals with sex predators, a campaign that advocates hope to take to Washington and other state capitols.
Calls to stiffen penalties for child sex offenders began almost the moment Gardner was arrested Feb. 28, three days after he attacked Chelsea on an afternoon run in San Diego, strangled her, and buried her in a shallow, lakeside grave.
Gardner served five years of a six-year prison sentence for beating and molesting a 13-year-old girl in San Diego in 2000. He faced a maximum of nearly 11 years in prison, but prosecutors called for six years.
A court-appointed psychiatrist urged the maximum sentence allowed by law. He said in court documents that Gardner was a "continued danger to underage girls" and "an extremely poor candidate" for treatment.
Maurice Dubois, Amber Dubois's father, says in a statement to be read Friday that psychiatrist Dr. Matthew Carroll "was the only one who saw Gardner for what he is, a dangerous predator interested in young girls."
In the statement, Dubois likens his daughter's killer to a mountain lion, whose instincts are to stalk and attack. If the zookeeper frees the lion from captivity, he asks, who is responsible for the killings that come after?
Dubois heaps blame on the criminal justice system.
"It's obvious the legal system failed us here, with all of the missed opportunities that ultimately allowed this monster to stalk our streets and harm our loved ones," Dubois writes in his statement, released Thursday in San Diego Superior Court.
The case has put California's parole system under the microscope.
Gardner lived little more than a football field's length from a San Diego preschool for at least 16 months while on parole from 2005 to 2008. That violated a condition of parole that prohibited him from living within a half-mile of a school.
A corrections department official let him stay until his lease expired in 2006 but no one noticed he was still living there until a year later. The parole board could have sent him back to prison but kept him on parole, where he had six other less serious potential violations.
Gov. Arnold Schwarzenegger has ordered a state board to review the parole system.
Brent and Kelly King, Chelsea's parents, are leading a campaign for "Chelsea's Law" to allow life sentences for some convicted child molesters in California and lifetime electronic monitoring of others. The bill, which cleared its first legislative committee last month, would also ban sex offenders from parks.

The entire article is very well written and contains a lot of great suggestions. They should not be let out ever. When they are free to roam - and they are free because 1/2 mile from a school is not far enough away - and if they are still allowed in parks...

Carrie McGonigle will talk about Friday's sentencing of her daughter's killer

The mother of slain Escondido teenager Amber Dubois is scheduled to appear on ABC’s “Good Morning America” on Monday to speak about the sentencing of her daughter’s rapist and killer.
Carrie McGonigle arrived in New York Saturday afternoon with her daughter, Allison, and a friend, said a family spokesman. The show is scheduled to air from 7 to 9 a.m. on KGTV-Channel 10. The specific time of her interview has not been set.
Sex offender John Albert Gardner III was sentenced Friday to life in prison without the chance of parole in the rape and murder of Amber, 14, and Chelsea King, 17, of Escondido.
It is unknown if McGonigle will discuss portions of the jailhouse talk she had with Gardner Wednesday. She has said Gardner answered many of her questions during the face-to-face meeting, including how he abducted Amber.
McGonigle has said that she wants to share the information with family before she discusses it publicly.

Confessed Murderer Spoke About Other Cases in Post-Sentencing Interview With Police

In the hours after he was sentenced to life in prison for the rapes and murders of two southern California teenagers, John Gardner told authorities there are other crimes he may have been involved with.
At a news conference today, officials from several police agencies and the district attorney's office released previously withheld information about the Gardner cases, including the DNA evidence that initially led police to arrest the 31-year-old convicted sex offender in the February murder of 17-year-old Chelsea King.
The investigation into any other crimes Gardner may have committed is ongoing. Officials declined to elaborate on what specific criminal activity he may have been involved with beyond the possibility of other assaults.
Gardner didn't implicate himself in any other murders, police said, but investigators are taking a closer look at every missing persons case in the area involving women in their teens and 20s.
A task force comprised of members of nine agencies, including the FBI, was set up after King's murder to investigate any other crimes that could be tied to Gardner. It is still active even with Gardner behind bars for life.
Police declined to reveal exactly how Gardner was able to overtake King, who was last seen jogging in a park near her home. The DNA evidence that initially linked Gardner to her murder, they said, was "body fluid" on her clothes that would normally be found during the course of a sexual assault.
King's DNA was also on the clothing, they said.
Gardner was sentenced Friday to three consecutive life sentences without parole for the rape and murders of King and 14-year-old Amber DuBois, and the attempted rape of another woman.
Amber DuBois' Mom Tells 'GMA' About Talking With the Killer
Amber's mother, Carrie McGonigle told "Good Morning America" today that Gardner told her in a jailhouse meeting that he forced Amber into his car on Feb. 13, 2009 by trapping her on a fenced street and threatening her with a knife and gun.
He "told her to get in the car or it would be a lot worse for her," McGonigle told "Good Morning America" today. "She had nowhere to go. She was stuck."
McGonigle, who had spoken with Amber about being approached by strangers in the weeks before her murder, pushed hard to meet with Gardner before he was sentenced to learned why he targeted Amber and how he captured her.
"She was in the wrong place at the wrong time," the mom said.
McGonigle said Amber had apparently taken a different route to school that morning for reasons she'll never know. Gardner said he found her one block over from her normal path.
"He said, 'I had a knife and a gun,'" she said. "He says he didn't show it. I don't know."
Gardner has said he drove Amber about a half-hour north of her hometown where he raped and killed her. McGonigle said she intended to keep most of the details of her conversation with Gardner private out of respect for Amber's father and the rest of her family who don't want to hear the details.
"I needed answers," McGonigle said. "I waited 15 months, and I needed some answers."
Gardner's response, she said, gave her closure.
Now focused on her younger daughter, 7-year-old Allison, McGonigle said she needs to let go of the miserable emotions she let overtake her in the past 15 months.
"I don't want to hold on to all that anger and all that hate," she said.
And while she has vowed not to let Amber's death make her unreasonably overprotective of Allison, McGonigle said a recent comment by a construction worker about Allison got to her.
""He said, 'Oh your daughter is beautiful.' I snapped," she said. "I yelled at him. It does rear up."
Confronting a Killer
On Friday, parents of both girls used Gardner's sentencing to speak directly to him, to try to make Gardner understand exactly what he had ripped from their lives.
"You dismantled a family life that was built on love, trust and faith, but you did not destroy it," Kelly King, Chelsea's mother, said Friday. "Look at me!"
Gardner refused to look at her.
Parents of both teens played video tributes to their daughters.
"You have taken a bright shining star from this community and our world away, and for what purpose?" she asked Gardner. "To serve your sick, twisted, perverted mind."
"I hope you suffer 100 times the amount of pain that we have suffered because of your crimes," said Amber's father, Maurice Dubois.
Gardner also pleaded guilty to attempting to rape Candice Moncayo, a 22-year-old jogger, near the spot where he attacked Chelsea.
With his head bowed -- tears staining his kelly-green prison garb -- a seated and shackled Gardner occasionally contorted his face uncomfortably throughout today's hourlong sentencing hearing.
McGonigle said she got a glimpse of the rage Gardner has talked about during sentencing when Moncayo taunted him about his nose, the spot where she hit him to get away.

Moe Dubois wants sex offender driver's licenses to be branded

The father of slain Escondido teenager Amber Dubois recognizes that legislation he plans to unveil Tuesday could receive a hostile reception in some Capitol corners.
Nevertheless, Moe Dubois is convinced that requiring convicted sex offenders to always carry a distinctive driver’s license or state-issued identification card will help police and businesses better protect children from predators.
“Do I think it’s going to pass through smoothly? No,” Dubois said in a telephone interview.
If it stalls, Dubois vows to bypass lawmakers by appealing directly to voters.
“I have a feeling it will get stopped in one of the committees. Then we’ll pursue it via an initiative,” he said. “There are many more people who want protection for their children from predators.”
Assemblymen Paul Cook, R-Yucca Valley, and Pedro Nava, D-Santa Barbara, have signed on to jointly carry the driver’s license measure as part of a four-bill package aimed at sex offenders.
Those proposals are designed to help law enforcement authorities more quickly respond when children are taken, including the formation of a state rapid response team of experts to assist local authorities responding to abductions.
Amber, 14, disappeared while on her way to school on Feb. 13, 2009. Her body was not found until a year later. John Albert Gardner III, 31, a convicted sex offender who had been released from parole supervision, earlier this month pleaded guilty to the rape and murder of Amber and 17-year-old Chelsea King, 17, of Poway. He is serving two life sentences without the possibility of parole.
Chelsea’s parents, Kelly and Brent King, have been active in the campaign to pass “Chelsea’s Law” that increases penalties for violent sexual crimes. Assembly Bill 1844 goes before the Assembly Appropriations Committee Friday.
Dubois and supporters plan to release his proposals Tuesday because May 25 is National Missing Children’s Day, first proclaimed by President Reagan in 1983.
Under Assembly Bill 589, all registered sex offenders would be issued special driver’s licenses that would identify them as such. If they do not drive, they must obtain a state-issued identification card, also with a distinctive mark.
The licenses or identification cards would have to be carried “at all times, outside of his or her place of residence,” the bill states.
Supporters say that will help police quickly identify sex offenders and scrutinize circumstances such as a child as a passenger or a toy in the back seat.
“The second they walk up to a vehicle they should know who they’re dealing with,” Dubois said.
Also, businesses could voluntarily require identification at events catering to children to ensure that sex offenders are not scouting for their next victim, supporters say.
Nava and Cook agreed with Dubois that the measure will face stiff resistance from civil libertarians and others who argue that tighter restrictions will not necessarily make the streets safer. Opposition has yet to emerge, given the newness of the proposals. Cost estimates have not been prepared. Sen. Mark Leno, D-San Francisco, a frequent critic of crime crackdowns, said he had not seen the legislation.
“It’s going to be tough,” said Cook, adding law enforcement authorities he has talked to welcome the license. “They really like it. It gives them a chance to react quickly. It could make a big difference.”
Said Nava, “I wouldn’t be surprised at all if the Legislature objects to the reasonable approach. Then the citizens of this state will take it upon themselves to get the results.”
Some states are ahead of California . Delaware, for example includes the letter “Y” on sex offender licenses. In Louisiana, it’s “SEX OFFENDER” in all-capital orange letters.
Ernie Allen, president of the National Center for Missing and Exploited Children, said his organization has not taken a position on marking driver’s licenses.
“We haven’t analyzed the effect ... We’d have to know a lot more about how it would help,” he said in a telephone interview.
But Allen is enthusiastic about other proposals to speed up responses.
“Time is the enemy in searching for a missing child,” Allen said.
Less controversial, but far from a guaranteed signature by the governor, are three other measures:
— Assembly Bill 1022 would establish within the Department of Justice the “California Missing Children Rapid Response Team” that would be available to help local police when children disappear. The team would also assist local officials with protocols, programs and technologies related to abductions.
— Assembly Bill 34 would require the state to file within two hours information about a reported missing child under the age of 16 to the Violent Crime Information Center and the National Crime Information Center. The current requirement is four hours.
— Assembly Bill 33 would require the Commission on Peace Officer Standards and Training to develop specialized guidelines and courses for law enforcement related to investigating missing children cases. That measure also seeks to make it easier for law enforcement to target sex offenders who live within five miles of the scene of a crime.
Gov. Arnold Schwarzenegger, who supports Chelsea’s Law, has not reviewed the new measures and does not have a position, said a spokeswoman.
Dubois has come up with a new proposal, which is much earlier in the formative stages. He wants to prevent impact statements from being released before victim families get to read them in court at sentencing. Dubois’ statement was released before Gardner was sentenced on May 14.
“I truly felt victimized,” Dubois said. “I want a law so that doesn’t happen to a victim’s family again.”

ESCONDIDO - Legislation proposed by the father of slain Escondido teen Amber Dubois unanimously passed by the state Senate Public Safety Committee Tuesday.
The legislation, called Assembly Bill 34, seeks to require law enforcement to report child abductions to national databases within two hours instead of the current four hours.
Maurice "Moe" Dubois has been working with legislators to come up with new laws for better coordinating law enforcement efforts when a child is abducted because his own 14-year-old daughter was abducted, raped and murdered last year.
Tuesday's approval comes one week after the state Senate Transportation Committee rejected other legislation backed by Dubois. In that instance, Dubois sought to require registered sex offenders to have distinctive driver's licenses.
Committee members worried over how such a law might brand minor offenders. They also complained that it did not include penalties for noncompliance.
Dubois conceded the points were valid and he would have to rework it.
Dubois also is pushing Assembly Bill 1022, a measure that would create a director's job within the Department of Justice that would be in charge of helping local agencies maintain strategies and technologies for finding missing children.
The Dubois family spent more than a year looking for their 14-year-old daughter, who disappeared in Feb. 13, 2009 while walking to Escondido High School.
After his arrest for the Feb. 25 rape and murder of 17-year-old Chelsea King, sex offender John Albert Gardner III led authorities to Amber's remains in Pala.
Gardner, 31, later pleaded guilty to raping and murdering both teens and was sentenced to a pair of life prison terms without the possibility of parole. He also admitted attacking another young woman in December in the same park where Chelsea was killed, but that victim managed to get away.

SACRAMENTO, Calif. (AP) — The parents of a Southern California teenager who was raped and murdered by a convicted child molester have filed damage claims against the state, according to documents released Thursday to The Associated Press.
Maurice Dubois and Carrie McGonigle, the parents of 14-year-old Amber Dubois, alleged the state corrections department missed chances to send John Albert Gardner III back to prison while he was on parole. They are seeking unspecified damages of more than $25,000.
The documents, which were filed June 10, were disclosed in response to the AP's inquiry.
Gardner is serving a life sentence after pleading guilty in April to murdering the girl after he was off parole. He also admitted to raping and murdering 17-year-old Chelsea King.
King family spokeswoman Sara Fraunces said the family will not comment because Thursday was their daughter's birthday. The King family has not filed a claim, said Lynn Margherita, a spokeswoman for the Victim Compensation and Government Claims Board.
Amber Dubois was kidnapped, raped and murdered in February 2009 as she was walking to Escondido High School in the San Diego area. Gardner led police to her body in March 2010 after his arrest in Chelsea's death.
The DuBois family's damage claims were made public the same day state lawmakers approved a $20 million payment to the family of Jaycee Dugard, who was kidnapped as a girl and held captive in Northern California for 18 years by a paroled sex offender, Phillip Garrido. The state agreed to pay the money to Dugard and her two daughters.
The allegations by Amber's parents are similar, alleging that parole agents failed to do their job.
Gardner "violated his parole at least five times while on probation (sic) for molesting and beating a teenage girl in 2000, and each time he was left on the street," said the claims filed by attorney Robin Sax. "Our claim follows the meeting (of the) California Sex Offender Management Board which questioned why John was not sent back to prison for parole violations in 2007 and 2008. Had he been returned to prison, he would have been evaluated for commitment to a state mental hospital as a sexually violent predator."
Margherita said the board had not yet begun processing the claims. She said it was unclear if they will be negotiated in the same way as the Dugard family settlement.
Christine Gasparac, a spokeswoman for the state attorney general, declined to comment.
Sax and the state Department of Corrections and Rehabilitation did not immediately respond to requests for comment.

The NBC television show Dateline will air a two-hour documentary Friday night about the murders of Amber Dubois and Chelsea King.
The show will air at 8 p.m. Friday on NBC 7/39.
The documentary is the first of at least two that have been produced about the case. In addition, at least one book by local crime author Caitlin Rother is being written.

ESCONDIDO — Today would have been Amber Dubois' 16th birthday.
To honor her memory Amber's mother, Carrie McGonigle, is inviting the public to a gathering at 8:30 p.m. at the spot in Escondido where Amber was abducted on Feb. 13, 2009 by John Gardner.
McGonigle said she has asked sixteen of Amber's special friends to share memories of her daughter at that time.

Saturday's "48 Hours Mystery" features interviews with Moe DuBois, who is Amber's father, Carrie McGonagle, who is Amber's mother, and a prison interview with John Gardner, the man who murdered her.
He talks about first seeing her on her way to school and how he got her into his car. Gardner, a sex offender, was on parole at the time.
The following is an excerpt of Gardner's interview, provided by "48 Hours Mystery."
"I passed her driving down the street. And that's the first time I saw her. I pulled up next to her with the windows down on the car. I had the knife out and visible. And told her that I also had a gun. And to get in the car or it was going to be a lot worse.

I feel bad for Amber's stepfather. He was a person of interest until Gardner led authorities to her remains in exchange for the death penalty being taken off the table.
It looked bad for her stepfather Dave because he wasn't getting along with Amber for most of the month before she went missing. He claimed they called a truce the night before she went missing. The day she went missing, he skipped work and said he went to the gym, and then came home and did his taxes. He also missed a message from the school's secretary saying that Amber didn't show up at school.
Amber's mom was even suspicious of him. She said Dave doesn't celebrate Valentine's Day, but he showed up at her work that day, one day before Valentine's Day, with chocolate covered strawberries and some roses and hung around for 45 minutes.
Amber's mom moved out six weeks after Amber disappeared and Dave ended up taking eight polygraph exams. He probably would have been a person of interest until the day he died if Gardner hadn't led police to her remains.

The failed polygraph came FIRST .....the beginning of the battery of EIGHT failed polys...
Carrie cud not get past the failed poly which seemed to vvalidate the set of circumstances..
No on will know, but I rteally wonder .. If Dave passed, I wonder if Carrie cud have found solace in that..If LE didnt influence and imply Daves involvement because of the failed poly.. cud she have gone past it??
Even though for this family, nothing matters now.. ruined lives... a teenage girl gone, and the family around her all ripped apart because of allegations and suspicioins all caused by LE and their implications becasue of the polygraph...
I really wonder when a large majority of ppl are going to really study and research this horrid inaccurate joke of a procedurre that stones ppl to death and lets LE off the hook for thorough investigations as they get to look up and investigate rumours and lifestyles of ones loved ones and let the media attention do them in ..then arrest them on something (i suspect it wont be long before we hear TH is arrested .. jmo though)
Its bad enough that the family wud have never beena ble to recover from such a senseloss loss, but they may have been able to struggle together...But with the damage the poly did .. Thats lost too...
How sad... how sad is it for Dave that he prolly cudnt even grieve for all the losses he was enduring while he was fighting to keep his freedom...
This case is not unusual, in fact it is typical.. It is the ppl who need to start . We need to throw away polys where the influence of them doesnt exist ... We need to stop playing the game where LE form their opinion and do the test and the resulsta re what they want them to be...
Enough is enough..

WHEN ARE WE GOING TO TOSS POLYGRAPHS IN THE TRASH...?
How many of these examples to we need to see before we can say BURN THE POLYGRAPHS ... They are more harmful than good.. They distract from monsters and peds, and allow LE to cast suspicion to the spouse/mother/GF/BF and allow a non investigation to happen and allow innconet ppl to be framed ... It osnt right.. There is something wrong with this and WE are allowing it to happen..
