Several hundred say their good-byes to Kayleah

Children in black, carrying flowers. That's how they came into the warm room in the downtown hotel, to say good-bye to Kayleah.

Children in laps, pre-teens, teens, and white haired grandmas were there. More than 400 standing-room-only to say good-bye to 12-year-old Kayleah Wilson, who disappeared March 28 in Greeley. Her body was found last week. Although the body hasn't been released by the police, there was a memorial service today at the Plaza Hotel and Convention Center, formerly known as the Clarion Hotel.

Her mother, April Wilson, spoke to the 400 people thanking everyone who helped, “people I know and don't know. Thank you for keeping her name out there. She's safe now.”

Pastor Aaron Chambers gave a sermon to the large crowd.

“Some things in life don't make sense. Kayleah should be hanging out now. She should be laughing. She should be listening to Celtic Thunder on her iPod. Some things just don't make sense,” he said.

Her family had a final ceremony at Sunset Memorial Gardens, not far from where she was found last week.

Boyfriend appears in court over Kayleah Wilson case

GREELEY - Robert Laurencio Montoya, the 18-year-old accused of having sex with 12-year-old Kayleah Wilson, appeared in a Weld County courtroom Tuesday afternoon.

Montoya appeared in court looking different after having his hair cut.

Kayleah's body was found in a Greeley drainage ditch May 19 after she went missing for nearly two months. Police say she was murdered.

Motoya was arrested on a sexual assault on a child charge the same day Wilson's body was found. In an arrest affidavit, he admits to having sex with the underage girl. Wilson also allegedly told friends she might be pregnant, according to the affidavit.

Montoya is being held in Weld County jail for the child felony on a $100,000 bond.

Montoya is not charged in Wilson's murder, and police have not named him a suspect in that investigation.

Some of his family members showed up to court on Tuesday. Michelle Galloway, his aunt, says she does not believe he killed Kayleah.

"I don't think so. Nothing came up until they got him for what they're charging him with, but I've never heard of any incidents. It's all news to us," she said.

According to the affidavit, Montoya lived with Wilson for a short time. When the mother of the alleged victim confronted her daughter and Montoya about having sex, he admitted to it.

Montoya also allegedly tried to see the victim without her mother's knowledge several times after he was told to stay away, including hiding outside her middle school after they had broken up.

Police interview dozens of sex offenders in Kayleah Wilson investigation

Detectives investigating the death of 12-year-old Kayleah Wilson have interviewed dozens of sex offenders, even checking into Nebraska and Colorado Springs, and continue to field tips from psychics and others, a police spokesman said.

Although the coroner's report hasn't been released and police haven't said the girl was sexually assaulted before her death, investigators continue to check sex offenders.

The girl's ex-boyfriend remains in the Weld County Jail on $100,000 bond and is facing charges of sexual assault on a minor. Police say he is a “person of interest” in the case but is not considered a suspect.

Kayleah disappeared March 28. Her body was found two months later in an irrigation ditch in west Greeley, and no arrests have been made in her death.

“It's frustrating,” Greeley police spokesman Sgt. Joe Tymkowych said of the case. “We still have detectives working it, checking anybody who is a sex offender within a hundred miles of here.”

GREELEY - While trying to convince the judge to lower his client's bond Thursday, Kevin Strobel said Robert Montoya, 18, had no connection with the disappearance of Kayleah Wilson, 12.

Wilson went missing in March. Her body was found two months later in an irrigation ditch. Police ruled her death a homicide.

Montoya is not accused of murdering Wilson, but has been charged with sexual assault on a child. Prosecutors say Montoya, who was more than four years older than Wilson, had a sexual relationship with the young girl.

On Thursday, Strobel, a public defender, said there are no witnesses that tie Montoya and Wilson together after mid-February. He added Montoya has cooperated with police and even passed a lie detector test.

Montoya was arrested in May and has been held on a $100,000 bond. Judge Marcelo Kopcow denied the defense's request to lower the amount.

Montoya also had his preliminary hearing Thursday. Prosecutors had to convince the judge there was enough evidence to move the case to a jury trial.

To do that, prosecutors called Kayleah Wilson's mother, April Wilson, to the stand.

Wilson testified that she suspected a relationship between Montoya and her daughter in December of last year. She said the two admitted to having sex after she confronted them in January.

Wilson said, after finding out about the relationship, she told Montoya, who had been living at her Greeley home since October, to move out.

She went on to say she saw the two together outside a car dealership once in February.

Greeley Police Detective Christian Morgan took the stand after Wilson. He said Montoya told investigators that he had sexual intercourse with Wilson 10 to 15 times.

Morgan said Montoya kept a diary, in which he wrote about Wilson several times. In one March entry, Morgan said Montoya wrote that he still felt "connected" to Wilson.

While questioning Morgan, Strobel asked whether the coroner found any evidence that Wilson was pregnant. Morgan said there was none, but added that visual signs do not show until 6 to 8 weeks into pregnancy.

Morgan also said Montoya's DNA was not found on Wilson's badly decomposed body.

Judge Kopcow decided there was enough evidence to push the case forward. A 4-day trial was set for November 15.

Even though a normal 18-year-old shouldn't want a twelve year old, I still don't think it is a good idea to let one that is a non-relative live in a home with teen or preteen girls. My oldest daughter is only 10 and I can't imagine an 18-year-old having sex with her in two years. It makes me sick.

I don't know if Kayleah's ex-boyfriend has a solid alibi, but I definitely agree that he should be a POI if he doesn't. I suspect the sexual relationship went on long after Kayleah's mother thought she ended it, and if the statements about him telling friends Kayleah might be pregnant are true, that would explain his motive. Even if he didn't kill Kayleah, he should be locked up for a very long time for having a sexual relationship with her.

GREELEY, Colo. -- The former boyfriend of 12-year-old Kaleah Wilson, found slain in Greeley last May, was supposed to go on trial Monday for allegedly sexually assaulting her.

However, the trial was vacated and a jury trial was set for March 21.

Robert Montoya, 18, is considered "a person of interest" in Wilson's death, but has not been named as a suspect, according to Greeley police.

Montoya is charged with sexual assault on a child and sexual assault with a pattern of abuse.

Police said Montoya admitted having sex with the sixth-grader 10 to 15 times before and after he turned 18.

No one has been arrested in Wilson's slaying.

GREELEY, Colo. -- The mother of a slain 12-year-old Greeley girl talked again Thursday about the first time she learned her daughter was having sex with an 18-year-old who was living in the same apartment.

April Wilson testified in a pretrial motions hearing for Robert Montoya in Weld County District Court. Montoya is not charged in Kayleah Wilson's death but faces charges of sexual assault on a child and sexual assault on a child with a pattern of abuse.

April Wilson related how she first found out about possible sexual relations between her daughter and Montoya when she read a posting on the family computer. She said she immediately confronted the two of them in a family meeting that occurred between Christmas and New Year's in 2009. She said Montoya had been living with the family for more than a couple of months at that time.

I'm glad these charges have been brought against him. Hopefully some answers will come soon on what happened to Kayleah.

A defense attorney for the man accused of sexually assaulting Kayleah Wilson before she disappeared last spring said the Wilson family is using the sexual assault case to hold him responsible for the girl’s death.

In a third day of hearings on pre-trial motions, attorneys on Tuesday argued what evidence should be admitted in the upcoming trial of Robert Montoya, who is charged with two counts of sexual assault against Kayleah Wilson. One charge involves a pattern of abuse.

It’s a case in which prosecutors are relying heavily on a grieving family’s recollections of incidents involving Montoya and Kayleah, which have been somewhat inconsistent as the case has worn on. The family has struggled with remembering time periods of specific instances involving Montoya, who had lived at the Wilson home for a few months in 2009. April Wilson learned of the sexual contact between the then 17-year-old Montoya and her daughter, and threw him out of the house.

No matter how the defense tries to spin it, any 17-year-old who has sex with a 12-year-old should be charged.

Yep, she was a child, a pre-teen. I hope he never gets out.

GREELEY, Colo. -- Opening statements are expected to begin Tuesday in the trial of the man accused of having sex with 12-year-old Kayleah Wilson.

Robert Montoya is now 19 years old and is charged with sexual assault.

Jury selection began on Monday. District Judge Marcelo Kopcow kept everyone late Monday night so there is a chance opening statements could begin Tuesday morning.

A jury of seven men and five women today convicted Robert Montoya on all charges in the sexual assault of 12-year-old Kayleah Wilson.

Jurors found there was a pattern of abuse for sexual activity with the girl, who went missing March 28, 2010. Her body was discovered May 19, and police have no suspects.

Montoya, now 19, could face from eight years to life in prison for the conviction on sexual assault on a child and sexual assault on a child involving a pattern of abuse.

GREELEY - A Weld County District Court judge has handed Robert Montoya a sentence of eight years to life for having a sexual relationship with a 12-year-old who was later found dead.

The indeterminate sentence is a direct result of a jury's decision to find the 19-year-old guilty of sex assault on a child on March 25. Montoya will have to complete a rigorous sex offender treatment program before he is ever eligible to be released from prison.
