Also, a hearing has been scheduled for June 1 concerning the defense team's fight to keep public records about Casey's visitors at the jail private and its request for Judge Perry to review some previous rulings made by Judge Stan Strickland before he recused himself over questions about his conversations with a blogger.

Judge Issues Plan For Anthony Hearing
Hearing Slated For Tuesday

POSTED: 4:07 pm EDT May 27, 2010
UPDATED: 4:49 pm EDT May 27, 2010

ORLANDO, Fla. -- Judge Belvin Perry made a change as to what controversial issues he will consider at a hearing in the Casey Anthony case on Tuesday.

The prosecution and defense have been going back and forth regarding how much prosecutors must reveal about why they're seeking to have Anthony executed.

Both sides have insisted they're right. The defense filed a motion to strike the state's so-called notice of aggravating circumstances because it lacks the detail to which they believe they're entitled.

When Perry ordered prosecutor Jeff Ashton to reveal the aggravating factors the state will argue to seek death against Anthony, attorney Jose Baez called it a major victory.

"We're elated by the fact that the judge is ordering this to occur," Baez said.

From elated to deflated: When Ashton filed that list, it was nothing more than five citations of law with no detail -- so little that Anthony's defense filed the motion to strike it as deficient. That motion will be argued before Perry at Tuesday's hearing.

"The aggravating factor issue is not complicated," defense attorney Richard Hornsby said.

Hornsby said prosecutors are not required to justify those aggravating factors or reveal before the trial their theory of how Caylee Anthony was killed or why her mother deserves to die for the crime.

"To Jeff Ashton, this aggravating factor issue is over. He has complied with it to the letter of the law, and he knows thatPerry is not required to give him any more information," Hornsby said.

Perry will consider the defense request to reopen four prior rulings by Judge Stan Strickland on Tuesday. He'll also rule on the motion to strike the state's list of aggravators as insufficient, and he'll also consider a defense motion for more forensic evidence.

Motions Hearing Set For Tuesday In Casey Case

Friday, May 28, 2010 7:22:00 AM

ORLANDO -- Chief Judge Belvin Perry has scheduled a hearing for Tuesday to consider several motions filed by Casey Anthony’s defense.

Perry will consider requests filed by Anthony's lawyers to seal her jail visitation logs, reconsider rulings made by the previous judge, Stan Strickland, and two other motions.

In another development, the state filed a motion in response to the defense's challenge to Florida's death penalty.

Prosecutors cited several precedents in asking the judge to deny the challenge.

More Death Penalty Motions Expected In Casey Case

Tuesday, June 01, 2010 6:19:19 AM
Reported by Jacqueline Fell

ORLANDO -- Several motions ruled on by Judge Stan Strickland will be back in court Tuesday.

Casey Anthony's defense team wants the motions reconsidered by Judge Belvin Perry now that Strickland stepped down.

There will also be more challenges to the death penalty.

The defense says the state hasn't justified its case.

Last week, the state responded saying it's too soon to make a decision.

This has been an ongoing battle between the defense and the state.

The judge ordered the state to tell the defense what aggravating circumstances existed when seeking the death penalty.

The list came within days. The defense says it's not specific enough.

Perry will likely make a final decision Tuesday.

Later this week, the defense will begin a vigorous schedule of depositions.

When Perry took over the case, he put strict deadlines on attorneys and ordered them to get to work.

On Friday, three people are set to be questioned under oath, including two sheriff's officials and Casey’s ex-boyfriend, Ricardo Morales.

This will be the first round of depositions that are scheduled nearly every week, for the rest of summer.

Judge To Reconsider Death Penalty In Anthony Case
Casey Anthony Charged With Murder In Death Of Daughter

POSTED: Tuesday, June 1, 2010
UPDATED: 6:40 am EDT June 1, 2010

ORLANDO, Fla. -- Casey Anthony's defense will have several motions reconsidered by Judge Belvin Perry, including whether or not the death penalty is appropriate in this case.

Judge Belvin Perry will reconsider four different motions Tuesday afternoon, including a request made by Anthony's defense team to throw out the death penalty.

Anthony, 24, is jailed on first-degree murder charges in the death of her daughter, Caylee, whose remains were found in a wooded lot in December 2008. Caylee was 2 years old when she was reported missing in July 2008.

Last month, the prosecution revealed the reasons they say Anthony should be put to death if she's convicted, including that the murder was committed during another crime -- aggravated child abuse. The state will also argue Caylee's murder was especially heinous or cruel.

Meanwhile, Anthony's defense team wanted the state to turn over forensic documents, including results on tests performed on evidence, but the state told the judge they didn't have the results. Other motions that will be addressed Tuesday include the use of certain forensic evidence.

Court officials told Local 6 the defense team is also asking the court to seal jail visitation logs.

Anthony has pleaded not guilty, claiming that she left Caylee with a baby sitter and the two were gone when she returned to pick up her daughter.

Tuesday's hearing is scheduled to start at 2 p.m. at the Orange County Courthouse and it will be streamed live on ClickOrlando.com.

Casey Anthony To Appear In Court Today
4 Motions To Be Heard By Judge Belvin Perry

POSTED: 6:19 am EDT June 1, 2010
UPDATED: 6:39 am EDT June 1, 2010

ORLANDO, Fla. -- Casey Anthony's defense wants the court to rule in their favor on four different motions in Orange County Court Tuesday afternoon.

The big motion on the table is that Anthony's attorneys want Judge Belvin Perry to force the state to give more specifics on why they are seeking the death penalty. At the last hearing, the defense said the state's answer didn't cut it.

Also, Anthony's defense will argue the previous judge's ruling about an illegally made tape-recording of an investigator interview should be reversed. The recording made by a volunteer searcher who says he searched the woods on Suburban Drive. He claims Caylee's remains were not there.

The third motion on the agenda is that Baez wants prosecutors to share forensic information they have not received so far.

Finally, the defense doesn't want the public to know who's visiting casey in jail. They want visitation logs sealed.

The hearing is at 2 p.m. at the Orange County courthouse. You can watch it live on WESH.com.

Death-penalty issues will be argued today
Orange-Osceola Chief Judge Belvin Perry is expected to hear defense arguments against the death penalty and other issues during today's hearing. Check back for live video at 2 p.m.

Casey Anthony's defense team will return to court this afternoon to argue several motions, including another battle about death-penalty issues.

The State Attorney's Office wants to execute Anthony if she is found guilty of killing her daughter.

Orange-Osceola Chief Judge Belvin Perry is also expected to hear other defense arguments, including her legal team's request to seal records showing who visits Anthony at the Orange County Jail.

Her team also wants more information about forensic evidence obtained so far.

The 24-year-old is charged with first-degree murder in the death of her daughter, Caylee Marie.

The toddler's remains were found in December 2008 — six months after her mother claims she last saw her alive.

A meter reader found the 2-year-old's remains in woods less than a mile from the Anthony family home.

Perry also will hear arguments on other issues, including access to grand-jury testimony by Anthony's father, George Anthony. The hearing starts at 2 p.m.

Judge To Hear Several Motions In Casey Hearing

Posted: 6:53 am EDT June 1, 2010
Updated: 8:56 am EDT June 1, 2010

ORANGE COUNTY, Fla. -- The case against Casey Anthony heads back to an Orange County courtroom Tuesday. Her attorneys will argue several motions, including some that have been heard before.

VIDEO REPORT: Casey Heads To Court

The defense will also challenge the reasons the prosecutors gave for pursuing the death penalty. Casey Anthony's attorney's demanded to know why prosecutors were going after the death penalty.

Judge Belvin Perry will hear motions involving jail visiting log records, rulings by a former judge, aggravating circumstances, and a supplemental motion to compel forensic evidence.

Friday, the defense will have to try to prove there is not enough evidence to show she allegedly killed her daughter during aggravated child abuse, and that it was done in a cold, calculated and pre-meditated manner.

Casey Anthony's attorney's want her visitor’s log at the Orange County jail kept private. They will also try to get Judge Belvin Perry Jr. to force an out-of-state lab, Oak Ridge laboratory, to release information about how they tested evidence in the case against Casey.

It's a motion that was already denied by the previous judge in the case.

Judge Stan Strickland said Orange County judges have no jurisdiction in Tennessee, which is where Oak Ridge laboratory is located.

Can Casey Defense Get Death Penalty Dropped?

Tuesday, June 01, 2010 7:30:22 AM
Reported by Mark Jenkins

ORLANDO -- As Casey Anthony’s defense team heads back to court Tuesday, lawyers said they want to convince the judge to drop the option for the death penalty.

The defense has asked the state of Florida to list the aggravating factors that would justify seeking the death penalty if Casey is found guilty of murdering her 2-year-old daughter, Caylee.

The state quickly did that, listing five of the possible 15:

1. The victim was younger than 12 years old.
2. The victim was particularly vulnerable because her killer was her mother.
3. Murder was committed during aggravated child abuse.
4. Murder was cold, calculated and premeditated.
5. Murder was especially atrocious.

Still, the defense argued that was not specific enough.

They’ll get into more of the specifics inside the courtroom at 2 p.m. Tuesday.

Stay with News 13 and cfnews13.com for updates from the Orange County Courthouse throughout the day.

Today’s Hearing: Death or Cake

Posted on June 1st, 2010 by Valhall

Today’s hearing will be over four defense motions. The first is a motion requesting the court strike the prosecutors’ response to the court’s order that they produce the aggravating circumstances that would justify seeking the death penalty in the Casey Anthony murder trial. The prosecution responded to this order by simply listing the Florida statutes for the specific aggravating circumstances they believe apply in this case. The defense had hoped to get specificity in the response (i.e. insight into the prosecution’s case). Mr. Richard Hornsby has stated in an interview with WESH that the prosecution is not required to give further justification as to why they believe the listed aggravating circumstances apply in this case. Since the defense has repeatedly refused to produce discovery, or publicly produce names of certain experts they plan to use based on their own argument that they are not required to divulge their strategy, the defense’s request that the state produce what would amount to “work product” is a case of the defense wanting to save the cake and eat it too.

Also up before the court today will be a motion for reconsideration of several motions previously heard by Judge Strickland. Included in these motions are the defense’s request to be provided a copy of the illegally-obtained recording of the conversation between Joseph Jordan and the defense’s investigator, Mort Smith; to be provided a copy of the same portion of the grand jury testimony of George Anthony that the State has been provided via ruling by Strickland; as well as other defense motions concerning tips and the TES records.

The third motion has to do with Linda Kenney Baden’s motion to compel certain forensic discovery the defense states they have previously requested but have yet to obtain. A large amount of this evidence is attached with the work at ORNL and as the state has previously argued, it is not the state of Florida’s obligation to produce this evidence, but the defense’s responsibility to subpoena whatever they want from either the FBI laboratory or ORNL. In other words, the state feels they have produced all evidence they have and intend to use from these entities and if the defense wants more that the state is not interested in, they need to be attempting to force the individual laboratories, who fall outside the jurisdiction of the State of Florida, to produce whatever it is they want.

And then lastly, the defense is requesting that Casey’s visitation log at the OCSO jail be sealed. Here’s “the cake and eat it too” syndrome rearing it’s ugly head again. The defense’s hypocrisy knows no bounds – while in the same hearing they are attempting to force the state to reveal the prosecution’s strategy, they are making yet another attempt to hide their defense strategy behind a veil of secrecy by trying to prevent others from seeing what type of experts will be spending time with Casey leading up to her trial.

Valhall.

Can Casey Defense Get Death Penalty Dropped?

Tuesday, June 01, 2010 12:41:34 PM
Reported by Jacqueline Fell and Mark Jenkins

ORLANDO -- Casey Anthony is expected to be in an Orange County courtroom Tuesday afternoon as her defense once again fights to get the death penalty taken off the table.

Judge Belvin Perry is expected to hear several motions starting at 2 p.m.

The most important motion centers around the ongoing fight to save Casey Anthony from facing death.

Her attorneys had asked the state of Florida to justify seeking the ultimate punishment if Casey is found guilty of murdering her 2-year-old daughter, Caylee.

The judge sided with the defense, and ordered the state to list the aggravating factors for a death sentence.

The state quickly did just that, listing five of the possible 15:

1. The victim was younger than 12 years old.
2. The victim was particularly vulnerable because her killer was her mother.
3. Murder was committed during aggravated child abuse.
4. Murder was cold, calculated and premeditated.
5. Murder was especially atrocious.

Still, the defense argued that was not specific enough, and they need more information.

“We should be told what we’re charged with, what we’re facing, what exactly their aggravating factors are, and how they intend to prove it,” defense attorney Andrea Lyon said in May, when a slew of death penalty motions were heard.

Other motions up Tuesday include an attempt by the defense to keep Casey’s jail logs private.

The defense will also bring up a number of motions ruled on by Judge Stan Strickland, who has since removed himself from the case, to see if Judge Perry will reverse any of those decisions.
