Evidence list goes to judge —not public
The Casey Anthony defense team filed a 'notice of compliance' today, saying it has indentified a list of items held as evidence that it wants to inspect.

In keeping with a judicial order, the Casey Anthony defense team filed a "notice of compliance" today, saying it has indentified a list of items held as evidence that it wants to inspect.
But the list — and the items on it — have not been made public.
The list of items the defense wants to review was not available through the Clerk of Court's office because the list wasn't filed there. Instead, it was provided to Chief Judge Belvin Perry.
Last week, Perry set a noon deadline today for the defense to provide the evidence list. Defense attorneys and their experts plan to review evidence held by the Orange County Sheriff's Office next week.
It was not immediately clear if the list will be made public.
The notice of compliance was filed shortly before 11:30 a.m. It was filed by attorneys J. Cheney Mason and Jose Baez.
The notice says the defense team met with prosecutors Monday and went through evidence property forms submitted by the Orange County Sheriff's Office. "The defense selected all items it wishes to inspect," the document states.
The prosecution and defense kept copies of the list of evidence to be inspected and "the defense is also providing a copy to this honorable court forthwith," the notice says.

Defense makes deadline, WESH reports

Casey Anthony’s defense team had a deadline today about the evidence it wants to examine. The defense evidently made the deadline — in its own way.
“They have met the deadline, but they haven’t made specific what evidence they want to review,” WESH-Ch. 2’s Bob Kealing said at the top of the station’s noon newscast. “All they’ve filed with the clerk’s office is this notice of compliance saying that they had this meeting with prosecutors, they pointed out what they want to look at, but they’re not making any more of the evidence more specific.”
Kealing said that “it appears in private” that the defense handed a specific list to the judge’s office. Kealing said the station was working to get more details.
Anthony is charged with first-degree murder in the death of her daughter, Caylee.

“New cloak-and-dagger developments in the case against Casey Anthony,” WESH-Ch. 2 anchor Jim Payne intoned in introducing a story tonight.
Say what? It sounded like a spy novel.
“It certainly appears that the defense team is trying to keep a list of evidence that they want to look at next week out of the public eye,” WESH’s Bob Kealing said.
The defense team filed a notice of compliance instead of the list by a noon deadline today. The defense attorneys filed it with Judge Belvin Perry instead of through the clerk’s office.
Orlando defense attorney Richard Hornsby, who offers analysis for WESH, scoffed at the defense team’s strategy: “It’s public record. There is no difference between … giving something to the judge and giving something to the clerk.”
Kealing talked to a court official who agreed with Hornsby and said the list will be made public once the judge gets it.
In an update at 5 this evening, Kealing reported that a court official said the defense team e-mailed Judge Perry a link to property forms from the sheriff’s office and not an evidence list. Perry is on vacation.
“Perry’s going to have to figure out what he wants to do on this issue when he gets back in on Monday,” Kealing said.
Hornsby predicted that that the defense wants to look at Anthony’s car and the bag found with Caylee Anthony’s remains. Anthony is charged with first-degree murder in the death of her daughter, Caylee.

Casey's attorneys met the judge's deadline, which was Thursday at noon, to turn over the list. The list is public record, but the defense did not file it with the clerk and sent it to Chief Judge Belvin Perry late Thursday, while he's on vacation.
The judge expects to release it early next week.
Next Tuesday and Wednesday, four defense experts will examine the evidence at the Orange County Sheriff's Office.

What's so hilarious though, is that whatever they submit WILL eventually make it's way to the public. Even though the defense filed the Notice of Compliance with JP, he will only give it to the clerk to file... and once that happens... it's up for grabs. (Nevermind that that isn't what the judge ordered...) It amazes me that the defense thinks they are so smart.
I hope JP has a little something to say about this to the defense, but even if he does, we may never know.

After listening to the above tape, does this mean the defense may not get to have their meetings on Tuesday and Wednesday since they did not list what they want to look at? Will the judge have to call another hearing regarding the way they did this?

This just reeks of Bozo...Mr. Mason must have been too busy with his latest undertaking to hand hold him thru the proper procedure...Wonder if there will be a parting of the ways between the 2 of them??? Oh, well I can't imagine the famous experts delaying their trip at the last moment as this would mean an increase of out of pocket expences...

Dream Team of experts head to Orlando to inspect evidence

Casey Anthony's criminal defense team announced a veritable "dream team" of forensic and science experts headed to town this week to inspect evidence compiled by authorities in the murder case.
First up is Dr. Henry Lee, the well-known criminologist and pathologist often associated with the O.J. Simpson case, according to Casey Anthony attorney Jose Baez.
Also headed to town this week, he said, is Nicholas Petraco, an associate professor of chemistry and forensic science at John Jay College of Criminal Justice in New York City.
Likewise, Dr. Tim Huntington, an assistant professor at Concordia University, Nebraska, and a board-certified entomologist, will be here for the inspections, Baez said. Forensic entomology applies the study of insects to a legal context to help establish times of death and post-mortem movement of bodies, Huntington has said, according to the Concordia University website.
"I am one of only 15 board-certified forensic entomologists, so we are a small pool of experts to draw from," Huntington said on the Concordia site.
He has consulted on more than 50 death investigations in seven states and four countries. He belongs to the American Board of Forensic Entomology; American Academy of Forensic Sciences; Entomological Society of America; North American Forensic Entomology Association; and Nebraska Chapter of the International Association for Identification, according to the site.
At Concordia, Huntington teaches biology, anatomy and entomology courses.
Also scheduled to appear are Dutch forensic scientists Richard and Selma Eikelenboom, pioneers in the field of "Touch DNA." Richard Eikelenboom's work helped get the murder conviction of Tim Masters in Colorado thrown out, after DNA testing.
The inspection of items in the Casey Anthony case is supposed to run Tuesday and Wednesday.
Chief Judge Belvin Perry has not yet decided whether to release a series of Sheriff's Office property forms or receipts identifying the items the defense wants to inspect this week. But Baez has said the primary items requested by the defense center around the recovery scene where 2-year-old Caylee Marie's body was found in late 2008.
Both the prosecution and defense have until 4 p.m. Tuesday to file motions if they are opposed to the release of the receipts, a court spokeswoman said today.
Anthony, 24, is charged with murder in the death of her daughter. The toddler's remains were found in December 2008. She was reported missing months earlier.

Casey Anthony Accused Of Murdering Daughter, Caylee

ORLANDO, Fla. -- Several expert witnesses on Tuesday will get their first look at evidence in the murder case of Casey Anthony, who is accused of killing her daughter, Caylee.

The experts, including defense witness Dr. Henry Lee, who worked in the O.J. Simpson murder case, will gather at the Orange County Sheriff's Office to review items.
Anthony's defense team has said their experts will focus on evidence collected from the wooded area where the remains of Caylee were found in December 2008.
A DNA expert from Holland will look into the evidence, a hair expert will concentrate on strands found by investigators, and an entomologist will challenge what prosecutors said about flies being in the trunk of Anthony's car, her defense team said.
Anthony's defense team, led by attorney Jose Baez, is also trying to keep the 911 call placed by Anthony's mother, Cindy Anthony, out of court. The call, in which Cindy Anthony said it smelled like a body was inside her daughter's car, was made two years ago this week. Cindy Anthony is expected to testify about the call this week.
Prosecutors said the call should be admissible in court, arguing 911 calls are essential to showing a jury how Casey Anthony put her stories together. The state also wants jurors to hear Casey Anthony describe her daughter's alleged kidnapper for the first time.
Anthony, 24, is being held at the Orange County Jail on first-degree murder charges in her daughter's death. Caylee was 2 years old when she was reported missing in July 2008. Her remains were found about five months later near the Anthony family home.

Casey Anthony Accused Of Murdering Daughter, Caylee

ORLANDO, Fla. -- Several expert witnesses on Tuesday will get their first look at evidence in the murder case of Casey Anthony, who is accused of killing her daughter, Caylee.
VIDEO: Experts To View Evidence
The experts, including defense witness Dr. Henry Lee, who worked in the O.J. Simpson murder case, will gather at the Orange County Sheriff's Office to review items.
Anthony's defense team has said their experts will focus on evidence collected from the wooded area where the remains of Caylee were found in December 2008.
A DNA expert from Holland will look into the evidence, a hair expert will concentrate on strands found by investigators, and an entomologist will challenge what prosecutors said about flies being in the trunk of Anthony's car, her defense team said.
Anthony's defense team, led by attorney Jose Baez, is also trying to keep the 911 call placed by Anthony's mother, Cindy Anthony, out of court. The call, in which Cindy Anthony said it smelled like a body was inside her daughter's car, was made two years ago this week. Cindy Anthony is expected to testify about the call this week.
Prosecutors said the call should be admissible in court, arguing 911 calls are essential to showing a jury how Casey Anthony put her stories together. The state also wants jurors to hear Casey Anthony describe her daughter's alleged kidnapper for the first time.
Anthony, 24, is being held at the Orange County Jail on first-degree murder charges in her daughter's death. Caylee was 2 years old when she was reported missing in July 2008. Her remains were found about five months later near the Anthony family home.
Anthony has pleaded not guilty.

ORLANDO, Fla. -- Beginning Tuesday, Casey Anthony's defense team will have a chance to look over evidence in the murder case against their client.
The defense team will review items of physical evidence including hairs collected from Casey's car and the duct tape found on her daughter Caylee's skull.
The car, the trunk, the duct tape, the items found with Caylee's remains which could tie them to her grandparents home. All are expected to be reviewed by Anthony's defense experts at the sheriff's office on Tuesday and Wednesday.
So far, the list of items submitted by the defense to Judge Belvin Perry has not been released.
"They want to know what evidence is relevent and which evidence is not going to be relevant," Criminal defense attorney Tom Luka said.
Luka has been representing Casey's brother, Lee Anthony. According to Luka, these inspections give Casey's defense experts a chance to see much of the evidence for the first time and make sure there are no surprises.
"Basically the defense is saying you have to show us all the evidence nine months prior to the trial, so we can properly prepare the case," Luka said.
Because this case is so circumstantial, observers say it could come down to a battle of experts. So what these experts see and observe about the physical evidence is crucial.
"13It's going to ultimately come down to the experts," Luka said. "If that's the case, this case could turn on what these people say."
A spokeswoman for the ninth circuit said if no one objects, Perry will release it to the public.
On Thursday, Casey's mother, Cindy Anthony, is expected to testify as the two sides contest admissibility of her 911 calls.
Anthony is being held at the Orange County Jail on a first-degree murder charge in connection with the death of her daughter, Caylee Anthony. She is being held without bond in connection with the toddler's death and faces the death penalty if convicted.

Don't cha just love the way he ignores some of the questions??? like he's waving off "coffin flies"...I think it's funny that he couldn't get in for a while... I don't understand why the duhfense doesn't want the list of evidence they're gonna look at revealed...It's not like the public doesn't know what is there since most records were released...I don't see how that is gonna let anyone know what stragedy they will use...We all know it's there job to go after whateva they can to get their client OFF...Even it it does get to a battle of the eggspurts I don't think it will help KC any...

ORLANDO, Fla. -- Casey Anthony’s 'dream team' of experts started arriving in Orlando Tuesday to look over evidence, but it could be a long time before the public knows anything about the evidence being inspected.

Casey's attorneys are fighting to keep the list of evidence private. They turned over the list last week laying out what evidence they planned to inspect and a famous crime expert is looking over some of it Tuesday.
Both members of the defense and prosecutors were at the Orange County Sheriff’s Headquarters Tuesday. The defense team is there trying to keep the specific evidence they're looking at, which prosecutors already know about, secret from the public. Also, the sheriff's office is videotaping the evidence examination so there can be no question as to what happened there.
The defense team's experts showed up Tuesday morning for the first of two days scheduled for them to view key evidence, which was found with Caylee Anthony’s remains in the woods near her house. Taxpayers are paying for the experts and their travel from Connecticut, New York, and Nebraska, and possibly from the Netherlands, to go to the Orange County Sheriff's Headquarters to examine the evidence.
Dr. Henry Lee is among them. Lee caught fire from a California judge over the Phil Spector murder case. Lee was chastised by the judge over the disappearance of key prosecution evidence, the tip of the victim's fingernail, which could have proved that the victim had fought for her life.
WFTV reporter Kathi Belich asked Lee about it Tuesday.
“Are you worried that that could cause problems in the case against Casey if it comes up?” Belich asked Lee.
“No, no. I've done many cases after that. In Washington DC nobody mentioned that,” Lee replied.
Defense attorney Cheney Mason became angry when WFTV asked about whether he's concerned that Lee's problems in the Spector case will adversely affect his work in the case against Casey Anthony.
“Are you worried Dr. Lee's problems in the Phil Spector case will cause problems for your case?” Belich asked Mason.
“I think you’re the problem,” Mason replied.
The defense filed a motion Tuesday (read it) slamming the media in its effort to keep the items of evidence it's examining this week sealed from the public. One of the arguments it makes is that the media will not get to see the defense inspection of the evidence, but that's not really true; it's being videotaped by the sheriff's office and the judge said WFTV will get a copy of the videotape.
