ORLANDO, Fla. (WOFL FOX 35) - There's another motion in the case against Casey Anthony. The latest motion coming from Casey's defense team is affecting the media.
Anthony's defense wants the media to be kept out of the case. Her defense says that the Fist Amendment rights of the media violates their client's rights in a death penalty case, especially since the case has garnered national attention and local obsession by the media.
For example, in the motion to the judge, Casey's defense points out the fact that back on July 13, 2010 the media reported that Casey ordered "Crackers and Cocoa" from the commissarry of the Orange County Jail. They say the only purpose of coverage like this from the media is to embarass, harass and humiliate the accused and poison the jury pool.
Constant motions from Casey Anthony's defense team is affecting a lot of people. It was just earlier this month when an attorney for Casey Anthony's parents stepped down.
Brad Conway said he can no longer represent Cindy and George Anthony because of a motion filed by Casey Anthony's defense team, contained untrue allegations about him.
Now, Conway is a witness to an inaccurate legal pleading filed in court.

Casey Anthony's defense complains about public records
By Amy L. Edwards, Orlando Sentinel
4:32 p.m. EDT, August 24, 2010
Casey Anthony's defense team is tired of the public — and the media — learning about the mundane details of her life, such as what snacks she's been buying in jail.
Anthony's lawyers have previously objected to information — ranging from photographs of the 24-year-old to defense funding — being released in response to public records requests.
And on Tuesday, attorneys Jose Baez and Cheney Mason again renewed their request.
The defense attorneys filed a notice stating the First Amendment rights of the media "must give way to the constitutionally protected rights of the accused."

I honestly cannot imagine that the Judge would reverse any previous rulings based on the fact that the media is reporting, and the public knows, what KC orders in the commissary. How on earth he can state with a straight face that this reporting will keep her from getting a fair trial is just beyond me! Talk about grasping at straws......
WHO FREAKING CARES, JOSE?

Like it or not, Jose..... it's called the Florida Sunshine Law. Rather than to file frivolous motion after frivolous motion to try to stifle the law, you have two options:
1. Try to get the law changed through proper legislation;
2. Move to another state.
Either way, you need to SHUT UP and get on with the business of preparing a defense for your client. Judge Perry isn't going to change Florida Law to suit your client's whims.
Amazing that the public knowing what KC orders from the commissary embarrasses KC when her partying and not reporting her daughter missing does not.

The 6th Amendment:
"In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence."
The seven rights listed in the 6th Amendment include:
1. The right to a speedy trial
2. The right to a public trial
3. The right to be judged by an impartial jury
4. The right to be notified of the nature and circumstances of the alleged crime
5. The right to confront witnesses who will testify against the accused
6. The right to find witnesses who will speak in favor of the accused
7. The right to have a lawyer
You can read a short description of each of these 6th Amendment clauses here.

Sorry Jose, but I'm not feelin it. When the State asked for a gag order immediately following Casey's arrest, one of your very first emergency motions was to FIGHT THEM ON IT. You objected. Your motion was granted. So what happened, Jose? What changed your mind? Things not working our for ya? kh

Apparently, there were three Notices filed on the 24th:
Notice of Standing Objection of Abuse of Florida Statue Chapter 119.01
Renewed Notice of Standing Objection of Abuse of Florida Statute Chapter 119.01
2nd Renewed Notice of Standing Objection of Abuse of Florida Statute Chapter 119.01
The first is the "Notice of Standing Objection of Abuse of Florida
Statute Chapter 119.01" which objects to the release of information by
law enforcement, corrections and state attorneys office. Attached to
the notice was the "Crackers and Cocoa" article by WESH.com.
The second is the "Renewed Notice of Standing Objection of Abuse of
Florida Statute Chapter 119.01" which objects to the release of
information by JAC, the Judicial Administrative Commission (plus LE,
corrections and SA again- just to make sure they weren't overlooked on
the first notice, I guess). Attached to this notice is "Casey's defense
investigates George Anthony" article by WESH.com regarding the PI's
invoice that JAC paid.
The third is the "2nd Renewed Notion of Standing Objection of Abuse of
Florida Statute Chapter 119.01" which objects to the release of
information by all of the agencies listed in the previous two notices
again. Later in the notice they complain about the jail visitor's log
being released. Attached to this notice is "Casey Anthony Meets with
Psychologist" article by ClickOrlando.com.

So it boils down to the fact that KC and her defense team want the State of Florida taxpayers to pay for her indefensible defense.... but they don't want said taxpayers to know anything the money is spent on.
Nice try, Baez.

Notice it's Baez who tips off the press, Wesh in particular. He's the pot that calls the kettle black when those fine SA's have not been on one interview in the media, not one...it's not them who are releasing information to the public, it's the Sunshine laws!
Baez needs to stop whining and put his nose to the grindstone. He's wasted all this time while he took in almost $90,000 from the licensing fees of Caylee's photos and videos. Once all that money was spent, he then gets her deemed indigent but she's been indigent from day 1...he's not in this for the right reasons. Getting justice for Caylee is not what he's about. He's trying to free a child killer and do hope he's prepared for the outcome. Once the jurors see the totality of the evidence, how this woman never alerted authorities of an allegedly abducted child, she will be history, IMO....When Caylee gets justice, this prisoner will be brought to justice, for the rest of her sorry life....JMHO
