GREAT BEND, Kan. - A district court judge in Barton County has bound over Adam Longoria for all three theories that prosecutors believe he killed 14 year-old Alicia Debolt last year. However, Special Assistant Attorney General Kevin O'Connor stunned the courtroom when he announced that the state will formally drop its effort to seek the death penalty against the accused killer.

WICHITA, Kan. (AP) — Attorneys for the Kansas man accused of killing a 14-year-old Great Bend girl have asked the court to bar the teen's family from showing emotion in the courtroom during his trial.

Motion to Enjoin the Victim's Family and Friends from sitting Directly Before the Jury and from showing Emotion in the Courtroom During the Trial

COMES NOW the accused, Adam Longoria, by and through his counsel, and moves this Court pursuant to the Fourth, Fifth, Sixth, Eighth, and Fourteenth Amendments to the United States Constitution and Sections One, Five, Nine, Ten, and Eighteen of the Kansas Constitution to enjoin the victim's family and friends, or members of any victims' rights groups, from sitting directly before the jury and from showing emotion in the courtroom during the trial. In support of this motion, Mr. Longoria states as follows:

1. This is a capital murder case.

2. Even in the non-capital case, appeals to passion and prejudice and other inflammatory
appeals to the jury are totally impermissible. See Viereck v. United States, 318 U.S. 236, 247-48, 63 S.Ct. 561, 87 L.Ed 734 (1934); United States v. Garza, 608 F.2d 659 (5th Cir. 1979); United States v. Gasparo, 744 F.2d 438 (5th Cir. 1984); Parks v. State, 330 S.E.2d 686 (GA 1985); Conner v. State, 303 S.E.2nd 266 (GA 1983); and American Bar Association, Standards Relating to the Prosecution Function, Section 3-5.8(c) (1982).

3. One source of great emotion arises when the victim's family vents its obvious grief in the courtroom. See Fuselier v. State, 468 So.2d 45 (Miss. 1985) (reversing where trial court allowed the victim's daughter to sit within the rail).

4. For example, while it is very clear that the family, or the victims' rights advocates, come to court to support the prosecution's cause, it is equally clear that "the victim's survivors' opinions about the crime and the murderer is clearly irrelevant to any issue in a capital sentencing hearing." State v. Bernard, 608 So.2d 699 (LA 1992). See Also State v. Donesav, 265 Kan. 60, 959 P.2d 862 (1998) ("The admission of evidence in a murder trial regarding the victim's family, the victim's relationship with a spouse or family member and friends, the victim's character, and the details of the victim's last days before death which has been intentionally and not incidentally elicited by the prosecuting attorney during the trial, is patently improper and reversible error.") If— as is legally evident — such opinions cannot be expressed on the witness stand, they cannot be made clear by extraneous actions in the courtroom.

Wherefore, Mr. Longoria moves this Court to take action to ensure that such shows of emotionalism do not occur at his trial and for such other and further relief as the Court deems just and equitable.

The man accused of killing a Great Bend teenager will be in court Thursday. Adam Longoria's attorney and prosecutors will discuss several motions in his murder trial.

Longoria is charged with killing 14-year-old Alicia DeBolt in August of 2010. Her burned body was found at an asphalt plant, where Longoria worked.

WICHITA, Kan.— The weekend before she would have started her freshman year of high school, 14-year-old Alicia DeBolt bounded out of her house shortly before midnight, ready to party. She never came back home.

The next day, her family reported her missing, setting off a search that ended three days later when her charred body — with traces of duct tape on her ankles and face — was found at an asphalt plant just south of town.

On Monday, almost two years later, Adam Joseph Longoria will stand trial in her killing. Prosecutors hope a trove of hundreds of text messages, surveillance photos from the convenience store where he bought a half gallon of gas the night of her disappearance, gruesome crime scene photos and DNA evidence are enough to win a conviction.

Suspect offers interview - for price
Longoria says he'll talk to media after trial only if phone-card money sent.

In advance of his capital murder trial that starts Monday, Adam Longoria is already touting to media a chance to have the "first interview" at the conclusion of the case.

Longoria, charged with killing 14-year-old Alicia DeBolt in August 2010, sent a letter to The Hutchinson News, postmarked March 20 with the return address stamped from the Sedgwick County Detention Facility.

He first acknowledges in the letter that he can't talk about his case, due to a "gag order."

"Now, I do have a offer to present to you," the letter states. "My trial starts on March 26th of 2012.

Longoria's trial is expected to last two weeks, with jury selection lasting two to four days, according to Ron Keefover, media liaison in the case and the chief information officer for the Office of Judicial Administration.

Summonses were issued to 500 prospective jurors, of which 90 have already been excused, according to Keefover.

Adam Longoria trial will be streamed "Live".

Per my contact with KWCH - Wichita, KS on 3-25-12:

The trial will be streamed "Live" and their will be a "Live" court room blog by KWCH - Wichita, KS.

"They" don't expect opening statements until Wednesday or Thursday. KWCH won't have a live stream or live blog until then.

Jury selection starts Monday, 3-26-12. Jury selection is closed to cameras.

The trial is underway with jury selection today. 500 jurors were summoned. 90 released before trial proceedings got underway. Jury selection expected to take 2 to 4 days.

The Defense tried unsuccessfully to get the trial moved from Barton County. In numerous articles over the week-end it was stated that many feel it will be a challenge for both the Defense & Prosecution to seat a jury.

As stated in a comment upthread, this trial will be "Live Streamed" by KWCH - Wichita, KS when Opening Statements/testimony starts. Also, KWCH will "Live Blog" from the Court Room.

I think this will be an interesting trial. I've followed this case as it unfolded and as it slowly worked its way to trial.

Adam Longoria gives me the chills! Also, he seems to always have a smirk on his face.

I hope he is found guilty. Although the State elected to not seek the death penalty, if Longoria is found guilty he can be sentenced to Life without Parole.

I support justice for Alicia DeBolt!

Prospective jurors are being questioned by attorneys as the Adam Longoria murder trial gets underway in Great Bend.

The 12 jurors and 2 alternates who will decide Longoria's fate will be chosen from a pool of more than 400 qualified people.

Longoria is charged with capital murder in the death of Alicia DeBolt, 14. The teenager's burned body was found in August of 2010 at an asphalt plant where the defendant worked.

GREAT BEND, Kan. | All prospective jurors questioned Monday told a judge they had seen media coverage about the case of a former asphalt plant worker accused of killing a 14-year-old girl whose charred body was found at the plant.

Questioning by attorneys highlighted the difficulties of seating an impartial jury in a close-knit community where many prospective jurors in the capital murder case against Adam Longoria, 38, also knew the family or some of the witnesses. Several would-be jurors had attended a vigil for Alicia DeBolt after her August 2010 killing.

From what the local news said last night getting this jury is going to be a timely proccess. I hope they give us warning before the stream starts!
